LLEI ORG\u00c0NICA 1\/2023 DE 28 DE FEBRER<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Entren en vigor el pr\u00f2xim 1 de juny tres noves situacions d\u2019incapacitat temporal per tal de conciliar el dret a la salut amb l\u2019ocupaci\u00f3 de les dones.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SITUACIONS D\u2019IT PER CONTING\u00c8NCIES COMUNES:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Menstruaci\u00f3 incapacitant secund\u00e0ria o dismenorrea secund\u00e0ria associada a patologies pr\u00e8vies:<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Es defineix la menstruaci\u00f3 incapacitant secund\u00e0ria com una situaci\u00f3 d&#8217;incapacitat derivada d&#8217;una dismenorrea generada per una patologia diagnosticada pr\u00e8viament. Aix\u00ed doncs, queda fora d&#8217;aquest sup\u00f2sit d&#8217;incapacitat temporal la denominada dismenorrea prim\u00e0ria, \u00e9s a dir, els sup\u00f2sits de dolor menstrual que no estan associats espec\u00edficament a una patologia subjacent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Es tracta, doncs, de la menstruaci\u00f3 incapacitant secund\u00e0ria o dismenorrea secund\u00e0ria associada a patologies com l\u2019endometriosi, miomes, enfermetat inflamat\u00f2ria p\u00e8lvica, adenomiosi, p\u00f2lips endometrials, ovaris poliqu\u00edstics, o dificultat en la sortida de sang menstrual de qualsevol tipus, poguent implicar s\u00edmptomes com dispar\u00e8unia, dis\u00faria, infertilitat, o sagnats m\u00e9s abundants del normal.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Interrupci\u00f3 de l\u2019embar\u00e0s, volunt\u00e0ria o no.<\/li>\n\n\n\n<li>Gestaci\u00f3 de la dona treballadora des del primer dia de la setmana 39.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">PARTICULARITATS:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Menstruaci\u00f3 incapacitant secund\u00e0ria:\n<ul class=\"wp-block-list\">\n<li>No exigeix per\u00edode m\u00ednim de cotitzaci\u00f3.<\/li>\n\n\n\n<li>La incapacitat ha de ser secund\u00e0ria a altres patologies pr\u00e8viament diagnosticades.<\/li>\n\n\n\n<li>No hi ha recaigudes. Cada proc\u00e9s es considerar\u00e0 nou.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Interrupci\u00f3 de l\u2019embar\u00e0s:\n<ul class=\"wp-block-list\">\n<li>No exigeix per\u00edode m\u00ednim de cotitzaci\u00f3.<\/li>\n\n\n\n<li>Requereix assist\u00e8ncia pel Servei P\u00fablic de Salud i estar impedida pel treball.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Gestaci\u00f3 de la dona treballadora des del primer dia de la setmana 39:\n<ul class=\"wp-block-list\">\n<li>Per\u00edode m\u00ednim de cotitzaci\u00f3 com al subsidi per naixement, segons l\u2019edat. (*)<\/li>\n\n\n\n<li>Prevaleix el risc durant l\u2019embar\u00e0s sobre la IT.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\">PRESTACI\u00d3:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Menstruaci\u00f3 incapacitant secund\u00e0ria:\n<ul class=\"wp-block-list\">\n<li>Inici: primer dia de la baixa.<\/li>\n\n\n\n<li>Fi: mentre es trobi d\u2019IT.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Interrupci\u00f3 de l\u2019embar\u00e0s:\n<ul class=\"wp-block-list\">\n<li>Primer dia de la baixa: salari a c\u00e0rrec de l\u2019empresari.<\/li>\n\n\n\n<li>Inici: dia seg\u00fcent a la baixa.<\/li>\n\n\n\n<li>Fi: mentre es trobi d\u2019IT.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Gestaci\u00f3 de la dona treballadora des del primer dia de la setmana 39:\n<ul class=\"wp-block-list\">\n<li>Primer dia de la baixa: salari a c\u00e0rrec de l\u2019empresari.<\/li>\n\n\n\n<li>Inici: dia seg\u00fcent a la baixa.<\/li>\n\n\n\n<li>Fi: data del part.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">QUANTIA I PAGAMENT:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Menstruaci\u00f3 incapacitant secund\u00e0ria:\n<ul class=\"wp-block-list\">\n<li>Quantia:\n<ul class=\"wp-block-list\">\n<li>Dies de l\u20191 al 20: 60% base reguladora.
