\nEl Tribunal Superior de Just\u00edcia de la Comunitat Valenciana (TSJCV) ha sentenciat que les <\/span>professionals d’educaci\u00f3 especial no tenen l’obligaci\u00f3 d’alimentar mitjan\u00e7ant sonda nasog\u00e0strica<\/span> a l’alumnat que ho necessiti.<\/span><\/div>\n

\nEl tribunal acaba d’anul\u00b7lar, per considerar-les no ajustades a dret, les instruccions del Consell que obligaven a les educadores a realitzar aquesta tasca, els serveis jur\u00eddics de la Federaci\u00f3 d’ensenyament CCOO PV han assistit a dues educadores, que pr\u00e8viament havien fet una sol\u00b7licitud <\/span>de revocaci\u00f3<\/span> a l’Administraci\u00f3 que  va ser desestimada.<\/span><\/div>\n

\nUn jutjat de primera inst\u00e0ncia va estimar la demanda de les educadores, que va ser recorreguda pel Consell davant el TSJCV. Aquesta sent\u00e8ncia \u00e9s ferma i amb ella es conclou, que \u00abentre les funcions pr\u00f2pies de les educadores no estan les d’alimentar a l’alumnat d’aquesta manera pel clar perill que comporta i per no exigir-se’ls en el seu ingr\u00e9s ni en la provisi\u00f3 del lloc de treball coneixements en la manipulaci\u00f3 de sondes d’alimentaci\u00f3\u00bb.<\/span><\/div>\n

\nEl curs passat, CCOO ja v\u00e0rem denunciar aquesta situaci\u00f3 (clic <\/span>aqu\u00ed<\/a>), considerem que \u00e9s<\/span> un pas molt important per tal de recon\u00e8ixer funcions espec\u00edfiques que es poden extrapolar a altres intervencions sociosanit\u00e0ries que, per manca de legislaci\u00f3, hi ha companyes que es troben amb l’obligatorietat de dur a terme.<\/span><\/div>\n
