{"id":155002,"date":"2018-01-11T15:16:00","date_gmt":"2018-01-11T13:16:00","guid":{"rendered":"https:\/\/www.ccoo.cat\/educacio\/noticies\/prestacio-risc-dembaras-limeb\/"},"modified":"2022-07-16T20:45:14","modified_gmt":"2022-07-16T18:45:14","slug":"prestacio-risc-dembaras-limeb","status":"publish","type":"post","link":"https:\/\/www.ccoo.cat\/educacio\/noticies\/ajuntament-de-barcelona\/pas-ajbcn\/prestacio-risc-dembaras-limeb\/","title":{"rendered":"Prestaci\u00f3 risc d&#8217;embar\u00e0s a l&#8217;IMEB"},"content":{"rendered":"<h3>\n<a href=\"https:\/\/2.bp.blogspot.com\/-8bNZyNJ6Q6o\/WjejFyqnJdI\/AAAAAAAAF68\/q23a8tDTx74arOtpzlN0dMhuUgJDQ-6oQCLcBGAs\/s1600\/Medidas-de-prevenci%25C3%25B3n-durante-el-control-prenatal-450x357.jpg\" style=\"clear: right;float: right;margin-bottom: 1em;margin-left: 1em\"><img loading=\"lazy\" decoding=\"async\" border=\"0\" data-original-height=\"357\" data-original-width=\"450\" height=\"158\" src=\"https:\/\/www.ccoo.cat\/educacio\/wp-content\/uploads\/sites\/139\/2022\/07\/medidas-de-prevencic3b3n-durante-el-control-prenatal-450x357-2.jpg\" width=\"200\" \/><\/a>Des de CCOO us volem informar com tramitar la prestaci\u00f3 de risc d&#8217;embar\u00e0s.<\/h3>\n<p>\n<a name='more'><\/a><br \/>\n<a href=\"https:\/\/drive.google.com\/file\/d\/1ylqapkzIxZnkX5EHKWtT64ovZ2Kz-Ecl\/view?usp=sharing\" style=\"font-family: Verdana, sans-serif\">INFORMACI\u00d3 EN PDF<\/a><\/p>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nAquesta prestaci\u00f3 t\u00e9 com a finalitat protegir a la<br \/>\ntreballadora embarassada d&#8217;una situaci\u00f3 de risc, quan no resulti t\u00e8cnica o<br \/>\nobjectivament possible el canvi a un altre lloc de treball o l&#8217;activitat<br \/>\ncompatible amb el seu estat.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nEl subsidi es tramita a Mutua Universal que \u00e9s qui<br \/>\nautoritzar\u00e0 la fi de l\u2019activitat, sent aquest el dia d&#8217;inici del subsidi i<br \/>\nfinalitzar\u00e0 el dia anterior al part.<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nEs reconeix el subsidi per risc d&#8217;embar\u00e0s com una<br \/>\nprestaci\u00f3 derivada de conting\u00e8ncia professional, en compliment del <a href=\"https:\/\/www.boe.es\/boe\/dias\/2009\/03\/21\/pdfs\/BOE-A-2009-4724.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Reial decret<br \/>\n295\/2009<\/a>&nbsp;de 6<br \/>\nde mar\u00e7.<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\n<b>Quina situaci\u00f3 protegeix aquesta<br \/>\nprestaci\u00f3?<\/b><br \/>\n<b><br \/><\/b><\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nQuan en el seu lloc de treball existeixen agents,<br \/>\nprocediments o condicions de treball que poden influir negativament en la seva<br \/>\nsalut o la del fetus. Si la treballadora no es troba treballant (vacances,<br \/>\nbaixa IT o altres) no existeix el risc.<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nS\u00f3n benefici\u00e0ries d&#8217;aquesta prestaci\u00f3 les educadores<br \/>\nde bressol que presten atenci\u00f3 directa als infants (a partir de la setmana 26<br \/>\nde gestaci\u00f3) i les professores de m\u00fasica que exerceixen les funcions docents (a<br \/>\ndefinir segons l\u2019instrument i horari laboral).&nbsp;<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\n<a href=\"https:\/\/4.bp.blogspot.com\/-VaukAZOwj-4\/WT735dYAaGI\/AAAAAAAAFzQ\/uv_6RnvYemwWpF7v_oP4sDvz6kKFrjiRQCPcBGAYYCw\/s1600\/20170428_123051.jpg\" style=\"clear: right;float: right;margin-bottom: \/>\nrequisits exigits:<\/div>\n<ul type=\"disc\">\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Tenir<br \/>\n     relaci\u00f3 laboral amb l\u2019Institut d\u2019Educaci\u00f3&nbsp;&nbsp;<\/li>\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Estar<br \/>\n     en actiu al lloc de treball<\/li>\n<\/ul>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nNo es considera situaci\u00f3 protegida aquella en qu\u00e8 la<br \/>\npatologia que pateix la treballadora no est\u00e0 relacionada amb el lloc de treball<br \/>\ndesenvolupat, sent en aquest cas una situaci\u00f3 susceptible de derivar en baixa per<br \/>\nconting\u00e8ncies comunes.<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\n<b>Naturalesa de la prestaci\u00f3 econ\u00f2mica<\/b><br \/>\n<b><br \/><\/b><\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nLa gesti\u00f3 i el pagament correspon a l&#8217;entitat gestora<br \/>\no col\u00b7laboradora en la modalitat de pagament directe.<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nLa durada de la prestaci\u00f3 estar\u00e0 \u00fanicament limitada<br \/>\nper la pr\u00f2pia exist\u00e8ncia del risc, per la qual cosa la prestaci\u00f3 s&#8217;iniciar\u00e0 el<br \/>\ndia de la suspensi\u00f3 de l&#8217;activitat i finalitzar\u00e0 el dia anterior al part (inici<br \/>\ndel perm\u00eds maternal a c\u00e0rrec de l&#8217;Institut Nacional de la Seguretat Social,<br \/>\nINSS).<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\nTreballadora i empresa estan obligats a comunicar a<br \/>\nMutua Universal qualsevol circumst\u00e0ncia que impliqui la suspensi\u00f3 del dret al<br \/>\nsubsidi:<\/div>\n<ul type=\"disc\">\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Suspensi\u00f3<br \/>\n     del contracte de treball per maternitat (naixement del nad\u00f3).<\/li>\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Reincorporaci\u00f3<br \/>\n     de la dona treballadora al seu lloc de treball anterior o a un altre compatible<br \/>\n     amb el seu estat.<\/li>\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Interrupci\u00f3<br \/>\n     de l&#8217;embar\u00e0s.<\/li>\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Defunci\u00f3<br \/>\n     de la benefici\u00e0ria.<\/li>\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Extinci\u00f3<br \/>\n     del contracte de treball (pas a situaci\u00f3 d&#8217;atur).<\/li>\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Finalitzaci\u00f3<br \/>\n     de crida en contractes fixos discontinus.<\/li>\n<li class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">Per ser<br \/>\n     baixa en el R\u00e8gim especial de la Seguretat Social.<\/li>\n<\/ul>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\n<b>&nbsp;Com es pot tramitar la<br \/>\nprestaci\u00f3 de subsidi de risc durant l\u2019embar\u00e0s?<\/b><\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;text-align: justify\">\n\u00c9s una prestaci\u00f3 que ha de gestionar i sol\u00b7licitar la<br \/>\ntreballadora quan ho consideri (sempre que compleixi els requisits) Es<br \/>\nrecomana fer-ho entre 3 o 4 setmanes abans de la setmana 26 de gestaci\u00f3.<\/p>\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal;margin-bottom: .0001pt;margin-bottom: 0cm;text-align: justify\">\nTota la informaci\u00f3 amb la documentaci\u00f3 corresponent a<br \/>\nla tramitaci\u00f3 d\u2019aquesta prestaci\u00f3 est\u00e0 disponible al Bulevard
